Uniformed Services Employment and Reemployment rights ACT (USERRA)

On December 19, 2005, the Department of Labor (DOL) issued its final rules for the Uniformed Services Employment and Reemployment Rights Act (USERRA) which will be effective January 18, 2006. The new requirement states that “Each employer shall provide to persons entitled to rights and benefits under USERRA a notice of the rights, benefits, and obligations of such person and such employers under USERRA.” Further, the DOL has provided a poster which should be displayed in the same manner as Wage and Hour information. USERRA protects service members’ reemployment rights when returning from a period of service in the uniformed services, including those reservists or National Guard members called to serve, and prohibits employer discrimination based on military service or obligation. USERRA rights also extend to applicants.
The DOL Veterans’ Employment and Training Service (VETS) administers USERRA.
